Warren County Commissioners Public Meeting

November 13, 2019 12:18 p.m.

Jackson Courtroom

 

Commissioner Benjamin Kafferlin called the meeting of the Warren County Commissioners to order with Jeff Eggleston present. Commissioner Cindy Morrison was absent

 

Staff Present: Pamela Matve, Chief Clerk, Solicitor Nathaniel Schmidt, Lorri Dunlap, Grants Administrator, Michael Lyon, Zoning Officer, Lori Bimber, Register and Recorder, Ed Burris, Director of Veteran’s Affairs, Ken McCorrison, Director of Public Safety

 

Citizens Present: Josh Cotton (WTO), Connie Zaffino, David Kell, Ron Sutton, Janes Bugg, and Mat Wieldbob, Charles Andracki

 

Announcements: Commissioner Benjamin Kafferlin announced that the meeting is being recorded.

Correspondence: Commissioner Benjamin Kafferlin stated that none was received, and he will be sending letters out to all the 4H participants.

Minutes from the October 23, 2019 Meeting: no changes need made.

 

Fiscal Report: Commissioner Benjamin Kafferlin in the absence of Eric Hern, Finance Director stated there was cash on hand of $3,437, 424.00 and in the Erie Bank account a balance of $448,569.00.

Motion was made by Commissioner Jeff Eggleston, seconded by Commissioner Benjamin Kafferlin to approve today’s agenda, the minutes from October 23, 2019. Motion carried unanimously.

Repository Tax Bid:  Motion was made by Commissioner Benjamin Kafferlin, seconded by Commissioner Jeff Eggleston to accept the repository tax bid in the amount of $325.00 from Joseph Glarner & Eric Meneo for parcel SH-627-942800-000. Motion carried.

 

Resolution #3147 Authorizing Application for the 2019 CDBG funds: Motion was made by Commissioner Benjamin Kafferlin, seconded by Commissioner Jeff Eggleston to approve the application and intended uses for the 2019 CDBG funds as presented in the Public Hearing. Motion carried.

 

Ordinance #254 Approval to Amend the 2008 Zoning Ordinance by transferring R2 district to B district in Conewango Township: Motion was made by Commissioner Jeff Eggleston, seconded by Commissioner Benjamin Kafferlin to approve to amend the 2008 Zoning Ordinance by transferring R2 district to B district in Conewango Township as presented in the public hearing.

 

Commissioner Jeff Eggleston stated that he has mulled this over and his concern is that there is no real plan, a lot can happen. The flip side I that we have a resident of North Warren stating that one of the property owners just got his letter on Monday. Michael Lyon stated that the letters were mailed out three weeks prior to today’s hearing.

 

Commissioner Jeff Eggleston continued to state that generally this board has been active. To allow this, we will be changing a large foot print, a big change with no plan. It makes it hard for me with no more information.

 

Commissioner Benjamin Kafferlin stated that while he is sympathetic to keep a community together, he is also inclined to allow the change as property owners have the right to do with what they want with their properties.

 

David Kell stated that there is a plan, but at this time it is not public.

 

Nathaniel Schmidt stated that dealing with rezoning you have to make sure that there is no spot zoning, to which this is not spot zoning.

 

Commissioner Jeff Eggleston stated that he feels like possibly the neighbors are not properly understanding. Nathaniel Schmidt stated that all notices have been sent out and the law has been followed.

 

Michael Lyon stated that since the letters have gone out, he has gotten two phone calls with questions to which he was able to answer.

 

Charles Andracki stated you have to think about Vine Street.

 

Commissioner Jeff Eggleston stated that there are 11 property owners who want this done. This has been advertised, and has been before the Planning Commission.

 

Ed Burris stated that the County is always promoting development. Is there any information on job creations etc. to which David Kell stated that at this time no, it is not a public offer at this time?

 

Connie Zaffino asked if there is no way to take the suggestion of Commissioner Jeff Eggleston and contact every person in that neighborhood to make sure they understand.

 

Michael Lyon stated that letters were mailed, and this public hearing was advertised. Connie Zaffino stated that not understanding the situation makes a difference.

 

Commissioner Benjamin Kafferlin stated that for him, he feels it is up to the property owners.

 

With nothing further, the above motion was called and the motion carried unanimously.

 

Appointment(s) to the Library Board – Colette Bonavita: Motion was made by Commissioner Jeff Eggleston, seconded by Commissioner Benjamin Kafferlin to approve the appointment of Colette Bonavita to the Library Board for a three-year term beginning January 1, 2020. Motion carried unanimously.

 

Appointment(s) to the Warren County Planning Commission – Andy Brooks: Motion was made by Commissioner Benjamin Kafferlin, seconded by Commissioner Jeff Eggleston to approve the appointment of Andy Brooks to the Warren County Planning Commission. Motion carried unanimously.

 

Intergovernmental Agreement with PA State Police Talkgroup: Commissioner Benjamin Kafferlin stated that this agreement is an addendum to the agreement that is currently in place. This will allow various agencies to talk with the PSP on various incidents.

 

Motion was made by Commissioner Jeff Eggleston, seconded by Commissioner Benjamin Kafferlin to approve the Intergovernmental Agreement with PA State Police Talkgroup. Motion carried unanimously.

 

Discussions on Section 504 of the Rehabilitation Act of 1973: Lorri Dunlap stated that while there is nothing to approve at this time, we have to discuss the fact that I will be the ADA Compliance Coordinator for Warren County. Also, that we do not discriminate and if anyone feels they have been discriminated against they can call my office to file their complaint.

 

Award of the 2020 Tax Anticipation Note: Commissioner Benjamin Kafferlin stated that at the work session there were three bids received and Key Bank offered the lowest interest rate at 2.08%.

 

Motion was made by Commissioner Benjamin Kafferlin, seconded by Commissioner Jeff Eggleston to approve the agreement with Key Bank, at a fixed interest rate of 2.08%. Motion carried unanimously.
