Warren County Commissioners Public Meeting

October 12, 2016 12:00 p.m.

Commissioners Conference Room

Commissioner Cindy Morrison called the meeting of the Warren County Commissioners to order with Commissioner Benjamin Kafferlin and Commissioner Jeff Eggleston present.

Staff Present: Pam Matve, Chief Clerk, Fiscal Director Judith Albaugh, and Treasurer Dennis Munksgard

Old Business:

Agreement with West Law: Commissioner Cindy Morrison stated that during the meeting of September 28, 2016 we approved an agreement with West Law for the use by inmates at the county jail. We did find out however that the contract language was different than what was quoted. Therefore I would like to rescind our approval.

Motion was made by Commissioner Benjamin Kafferlin, seconded by Commissioner Jeff Eggleston to rescind the agreement with West Law and not sign the agreement presented. Motion carried unanimously.

New Business:

Approval of Minutes: Motion was made by Commissioner Jeff Eggleston, seconded by Commissioner Benjamin Kafferlin to approve the minutes from September 28, 2016. Motion carried unanimously.

Fiscal Report: Fiscal Director Judith Albaugh stated there was cash on hand of $4,618,190.00 and in the restricted account a balance of $743,287.00. Accounts payable for last week is $51,046.00. Judy stated that there is nothing out of the ordinary to report.

Motion was made by Commissioner Benjamin Kafferlin, seconded by Commissioner Jeff Eggleston to approve the fiscal report as presented. Motion carried unanimously.

Award of vehicle bids: Commissioner Cindy Morrison stated that we had opened the sealed bids at our work session and minimum bids were set on all five vehicles I think that we shall approve these one by one.

Motion was made by Commissioner Benjamin Kafferlin, seconded by Commissioner Jeff Eggleston to accept the bid in the amount of $2,250.00 from Walter Kuzminski for the 2006 Chevy Trail Blazer noting that the minimum bid was $2,111.00. Motion carried unanimously.

Motion was made by Commissioner Benjamin Kafferlin, seconded by Commissioner Jeff Eggleston to accept the bid in the amount of $2,400.00 from Barry Whisner for the 2007 Ford Explorer (Silver) noting that the minimum bid was $2,177.00. Motion carried unanimously.

Motion was made by Commissioner Benjamin Kafferlin, seconded by Commissioner Jeff Eggleston to accept the bid in the amount of $3,110.00 from Barry Whisner for the 2007 Chevy Impala noting the minimum bid was $2,1111.00 Motion carried unanimously.

Motion was made by Commissioner Jeff Eggleston, seconded by Commissioner Benjamin Kafferlin not to accept any bids on the 2007 Ford Explorer (White) as neither of the bids met the minimum set. Motion carried unanimously.

Motion was made by Commissioner Benjamin Kafferlin, seconded by Commissioner Jeff Eggleston to accept the bid in the amount of $2,950.00 from Barry Whisner for the 2008 Chevy Trail Blazer noting the minimum bid was $2,454.00 Motion carried unanimously.

Approval of various Landfill Agreements: Commissioner Cindy Morrison stated that there are several landfills that our pick up services use for the Solid Waste Authority. These have all been reviewed by out solicitor and he stated that everything was in line and ready to sign. These are all ten year agreements with the following facilities; Chautauqua Municipal Waste Processing, Hyland Facility, McKean County Landfill, Advanced Disposal for both the Greentree and Mostoller locations, and Waste Management for both the Northwest Landfill and Lake View Landfill. Do I have a motion to approve?

Motion was made by Commissioner Benjamin Kafferlin, seconded by Commissioner Jeff Eggleston to approve the various landfill agreements for the Solid Waste Authority as listed above. Motion carried unanimously.

Agreement with PA SAVIN for 2017: Commissioner Cindy Morrison explained that this program is what notifies a victim when an offender is released from jail whether it be on bail or work release.

Motion was made by Commissioner Benjamin Kafferlin, seconded by Commissioner Jeff Eggleston to approve the agreement with PA SAVIN for 2017 in the amount of $1,527.77. Motion carried unanimously.

Agreement with McKula Inc.: Commissioner Cindy Morrison stated that this agreement is for Incident Tracker software. She then turn it over to Commissioner Benjamin Kafferlin for a brief explanation.

Commissioner Benjamin Kafferlin stated that while this was explained in detail at Monday’s work session; this software will work for various departments Human Resources, Maintenance, Insurance etc. It will allow all types of information to be entered so that it can be tracked for reviews, areas that need fixing such as stairs, tracking slips and falls.

Motion was made by Commissioner Benjamin Kafferlin, seconded by Commissioner Jeff Eggleston to approve the agreement with McKula Inc. for the Incident Tracker software at a cost of $1,650.00 the first year. Motion carried unanimously.

Agreement for Treasurer’s Solicitor: Discussions took place with Commissioner Cindy Morrison asking Treasurer Dennis Munksgard why he felt the need to have his own solicitor when one is available to him. Treasurer Dennis Munksgard stated that his colleagues from the Treasure’s Association strongly suggested that he have his own in case there is ever conflicts with the Commissioners.

Commissioner Jeff Eggleston stated that he was ok with this agreement as it does not require a retainer and I would hope that this would help us to work together to resolve any issues there may be.

Commissioner Benjamin Kafferlin stated that he feels that we are required to allow this as it is stated in the county code.

Commissioner Cindy Morrison stated that the county code states the Commissioners may approve this it does not state that we are required and I feel that this will place more burden on the tax payers when we are already paying for a county solicitor; and if there are personal issues then if the Treasurer feels it necessary to get council involved then it should come out of his own pocket for the expense; otherwise county solicitor can handle issues.

Joe Scully asked if our county had a solicitor to which the answer was yes. I think this is a waste of our tax payer’s dollars, as the solicitor should be presented with the issue and if he or she felt there was a conflict of interest then it is for the solicitor to state to the commissioners that the other party needs to hire other council. And if it is due to a personal issue with another office, then it should come out of his or her personal pocket for the cost.

Commissioner Jeff Eggleston stated that it is not uncommon for other elected officials to have separate solicitors and I would hope this would help us to work together.

Motion was made by Commissioner Benjamin Kafferlin, seconded by Commissioner Jeff Eggleston to approve the agreement with Gary T. Nietupski to represent the Treasurer’s Office at a rate of $110.00 per hour. Motion carried 2 to 1 with Commissioner Cindy Morrison stating Nay.

Repository Tax Bid: Motion was made by Commissioner Benjamin Kafferlin, seconded by Commissioner Jeff Eggleston to approve the repository bid in the amount of $250.00 from Rodney Birt for parcel YV-003-844600-002, Sugar Grove Township. Motion carried unanimously.

Fiscal Director Judith Albaugh stated she had a question regarding the current year TAN payback. Discussions took place as to what is in our account currently and what is expected in and it was decided that she should use her best judgement on when to pay back on the TAN to save the county interest costs.

Adjournment: Motion was made by Commissioner Benjamin Kafferlin, seconded by Commissioner Jeff Eggleston to adjourn the meeting. Motion carried unanimously.
