Warren County Commissioners Public Meeting

April 10, 2019 12:00 p.m.

Jackson Courtroom

 

Commissioner Benjamin Kafferlin called the meeting of the Warren County Commissioners to order with Commissioner Cindy Morrison and Commissioner Jeff Eggleston present.

 

Staff Present: Pamela Matve, Chief Clerk, Phil Gilbert, Tax Claim, Lisa Rivett, Director of Elections, Ken McCorrison, Public Safety Director, and Kale Asp

 

Citizens Present: Josh Cotton (WTO), Joe Scully, Connie Zaffino, Rita Gillespie, and Pat Cole

 

Announcements: Commissioner Benjamin Kafferlin announced that the meeting is being recorded.

 

Commissioner Benjamin Kafferlin stated that he was out all last week, and there were no times where the commissioners were all together.

 

Commissioner Benjamin Kafferlin then stated that there is no written correspondence to pass along, but he did receive a phone call from a retired elected official regarding a cost of living raise on the pensions, and this is a matter for the retirement board.

Minutes from the March 27, 2019 Meetings: no changes

 

Fiscal Report: In the absence of Eric Hern, Fiscal Director, Commissioner Benjamin Kafferlin stated there                 was cash on hand of $1,063,418.00 and in the Erie bank account a balance of $647,637.00.

 

The payroll is expected to reduce the amount in the General Fund by approximately $285,000.00

 

                Proclamation(s):  Motorcycle Awareness Month, and Correctional Officers and Employees Week

 

After reading the Motorcycle Awareness proclamation, Commissioner Cindy Morrison stated that it is important to bring awareness to the various vehicles on the roads we all share.

 

Commissioner Jeff Eggleston stated that he looks at the Correctional Officers and Employees Week with two different views. Our staff in our Correctional Facility spend all day with the inmate from various crimes, and that is a hard job. But they also have a heart, and help with various programs so that these inmates can follow a different path when they leave.

 

Motion was made by Commissioner Cindy Morrison, seconded by Commissioner Jeff Eggleston to approve today’s agenda, the March 27, 2019 minutes, fiscal report as presented, and the proclamations as read. Motion carried unanimously.

 

Old Business:

 

Sharing GIS Information: Commissioner Benjamin Kafferlin asked Solicitor Nathaniel Schmidt if he as reviewed the agreement to which he stated that he will have it reviewed and asked Pamela J. Matve, Chief Clerk to place this on the agenda for next meeting.

 

New Business:

 

Approval of the Palmetto Posting Agreement: Commissioner Benjamin Kafferlin stated that this it to amend the current agreement extending the date of the agreement until December 2021 with all pricing the same.

 

Resolution #3136 Authorizing the creation of the 2020 Complete Count Committee: Commissioner Benjamin Kafferlin stated that we have been asked by the government to form a complete count committee for the 2020 census that will be happening in 2020. He then gave the list of people that have agreed to be a part of this committee.

 

Commissioner Benjamin Kafferlin then thanked Dan Glotz, Planning & Zoning Director for chairing this committee and for Pamela J. Matve, Chief Clerk for putting this together.

 

Commissioner Jeff Eggleston stated that the census is very important so that we get accurate numbers to get all the funding we deserve. The Census also determines what class county we are.

 

Motion was made by Commissioner Cindy Morrison, seconded by Commissioner Jeff Eggleston to approve Resolution #3136 Authorizing the creation of the 2020 Complete County Committee. Motion carried unanimously.

 

Repository Tax Bid(s): Phil Gilbert, Tax Claim Director stated that in the past we would accept a minimum bid of $250 for properties in the repository. Last year we decided to change this to the minimum cost of county’s cost. This has netted us an amount of approximately $10,000.

 

Commissioner Jeff Eggleston thanked Mr. Gilbert for initiating this change.

 

Motion was made by Commissioner Cindy Morrison, seconded by Commissioner Jeff Eggleston to approve the repository tax bid from Angela and Dennis Jacques in the amount of $1,600.00 for parcel

SH-365-8913-000 and the repository tax bid from Sarah Hacke in the amount of $2,500.00 for parcel WN-257-6444. Motion carried unanimously.

 

Five year Memorandum of Understanding with the Allegheny National Forest: Ken McCorrison stated that this memorandum of understanding is for the search and rescue within the ANF, it has nothing to do with patrols.

 

There was some discussion on the length of time of the patrol agreement with it comes due to extend this for a longer period of time.

 

Motion was made by Commissioner Cindy Morrison, seconded by Commissioner Jeff Eggleston to approve the Memorandum of Understanding between the ANF and the County for search and rescue with the Forest area. Motion carried unanimously.

 

Zelenkofske Axelrod agreement: Commissioner Benjamin Kafferlin stated that this agreement will extend our audit to cover FW Human Services along with the County.

 

Commissioner Cindy Morrison asked the question, “what if the Governing Board does not want to approve this agreement”.

 

Commissioner Benjamin Kafferlin stated that we would have to go out to bid or leave things as they are now.

 

Commissioner Jeff Eggleston stated that the cost is less than what they normally pay, do not know why they would not approve it.

 

Motion was made by Commissioner Cindy Morrison, seconded by Commissioner Jeff Eggleston to approve the agreement with Z&A for the Human Services audit. Motion carried unanimously.

 

Agreement with US Army Corp of Engineers: Ken McCorrison, Public Safety Director stated that this agreement is for the sharing of technical and private information in the support of the Flood Emergency Plan with regard to the Kinzua and Tionesta Dams.

 

Motion was made by Commissioner Cindy Morrison, seconded by Commissioner Jeff Eggleston to approve the Agreement with the US Army Corp of Engineers for the sharing of technical and private information as presented. Motion carried unanimously.

Motion was made by Commissioner Cindy Morrison, seconded by Commissioner Jeff Eggleston to approve the Personnel as presented. Motion carried unanimously.

Commissioner Comments:

 

Commissioner Jeff Eggleston started the discussions on the LERTA program by stating that Commissioner Benjamin Kafferlin will not be able to attend the work session on Monday therefore we will take a few minutes today to have a discussion.

 

Commissioner Jeff Eggleston went on to list the municipalities that he has gotten support letters from, and he would like the opinion of the other Commissioners as to what they are willing to offer. Also, the City of Warren is willing to set a date for a Public Hearing to allow the citizens to comment. I think it would be good to have a joint public hearing that includes the county and all municipalities. Commissioner Benjamin Kafferlin stated that it was a good idea.

 

Commissioner Jeff Eggleston stated that proposals are coming in are five years with 100% abatement including new construction and some are wanting to offer 3 years and not include new construction. I would like to know what you think.

 

Commissioner Cindy Morrison stated that in order to get the most from the LERTA I think the 5 year, 100% abatement is the way to go and to include new construction.

 

Commissioner Benjamin Kafferlin stated that he does not agree but is out voted. He does not want to stop our commercial lerta, to which Commissioner Jeff Eggleston stated that we do need to review the current commercial lerta.

 

Commissioner Benjamin Kafferlin stated that he would like to encourage municipalities to go with what Commissioner Jeff Eggleston has defined except that he is not in favor of new construction or building on an empty lot.

 

Commissioner Cindy Morrison asked him to clarify what he means by building on an empty lot. Commissioner Benjamin Kafferlin then stated he would rather see a home being rehabbed getting the tax abatement. To which Commissioner Cindy Morrison did agree.

 

Ed Sekerak asked if the Titusville and Corry School district is on board with this. Commissioner Benjamin Kafferlin stated that he has met with Corry School District and they have mixed feelings.

 

Ed Sekerak stated that if you have the step programs you will see people tear all but one wall down, and call it a rehab project to get the tax abatement. The incentive is to get people to build here in the County.

 

Commissioner Jeff Eggleston stated that our goal is to create new useable properties, and to remove some of the barriers.

 

Connie Zaffino asked if they were targeting low income families. Commissioner Benjamin Kafferlin stated absolutely not, there is no cap on income.

 

Commissioner Jeff Eggleston stated that you can design your lerta requirements, such as capping the abatement amount.

 

Connie Zaffino asked if the municipalities will chose their requirements and the county will back them. Commissioner Jeff Eggleston stated that they will decide the model, and the county and school district will back them for that municipality.

 

Ed Sekarak stated by doing that you will be creating competition on where people will build based on the lerta. Commissioner Jeff Eggleston stated that will happen regardless as not all municipalities will participate at all.

 

Commissioner Jeff Eggleston stated that he will convey that the commissioners are willing to back a 5 year 100% abatement and initiate a joint public hearing.

 

Commissioner Benjamin Kafferlin stated that the commercial lerta will remain the same.

 

Adjournment:  Motion was made by Commissioner Cindy Morrison, seconded by Commissioner Jeff Eggleston to adjourn the meeting. Motion carried unanimously.
