Warren County Commissioners Public Meeting

February 10, 2016 12:00 p.m.

Commissioner Conference Room

Commissioner Cindy Morrison called the meeting of the Warren County Commissioners to order with Commissioner Benjamin Kafferlin and Commissioner Jeff Eggleston present.

Staff Present: Pam Matve, Chief Clerk, Treasurer Dennis Munksgard, Rene Johnson, Solicitor, Fiscal Director Judith Albaugh, Todd Lake, Public Safety Director, Karen Beardsley, Chief Tax Assessor, Aaron Kalkbrenner, Zoning Officer

Citizens Present: Brian Ferry (WTO), Mark Silvis (WNAE), Troy Clawson, Heather Wilcox, Doug Allen,

Mr. Miller, Richard Winkler, Dan Ristau, and John Mortenson

Public Hearing: Conditional Use Request from Tidioute Charter School

Aaron Kalkbrenner stated that Tidioute Charter School applied for a conditional use permit to expand their campus to the adjoining residential lot (24 Main St.) parcel TD-275-2586.

Aaron went on to state that the Charter School would like to use the dwelling for administration offices and future class rooms. This has been reviewed by the Planning Commissioner and they are in favor of this conditional use.

Cindy asked if all the neighbors have been notified and the legal advertising and posting has been done to which Aaron stated yes.

Mr. Winkler, Attorney for the School stated that the outside of the swelling will not change.

Commissioner Cindy Morrison swore under oath Mr. Allen who also stated that for now it will be used for administration offices. They do understand that if they are going to house class rooms, there are things that must be done for safety purposes.

Todd Lake stated that Public Safety and the Charter School have a great working relationship, they have helped store some safety equipment on their property.

After no further comments or questions, the public hearing was closed at 12:10.

New Business:

Conditional Use Request: Motion was made by Commissioner Jeff Eggleston, seconded by Commissioner Benjamin Kafferlin to approve the Conditional Use Request from the Tidioute Charter School for parcel TD-275-2586 at presented. Motion carried unanimously.

Approval of Minutes: Motion was made by Commissioner Benjamin Kafferlin, seconded by Commissioner Jeff Eggleston to approve the minutes from January 27, 2016. Motion carried unanimously.

Fiscal Report: Fiscal Director Judith Albaugh reported cash on hand of $1,188,559.00 and in the restricted account a balance of $741,454.00. County accounts payable in the total of $190,995.00 is being presented to you today, with $46,031.00 of this amount being jail expenses.

Motion was made by Commissioner Benjamin Kafferlin, seconded by Commissioner Jeff Eggleston to approve the fiscal report as presented. Motion carried unanimously.

Resolution #3062 Liquid Fuels Allocation for 2016: Commissioner Jeff Eggleston asked Pam Matve just for clarity; is the liquid fuels based upon population and road miles and when does this change? Ms. Matve stated that due to some road mile changes some municipalities may see a change this year even though we are using the same $140,000 distribution figure. The population amount really does not change until the census is done.

Motion was made by Commissioner Jeff Eggleston, seconded by Commissioner Benjamin Kafferlin to approve Resolution #3062 for the 2016 Liquid Fuels Allocations as listed. Motion carried unanimously.

Certification of Funds: Heather Wilcox gave a little history behind the Farmland Preservation and how it got started, and where it stands today. The farmland preservation gets the interest earned from the Clean and Green fees collected. And the county must certify these funds at a public meeting.

Commissioner Cindy Morrison stated that the interest earned in 2015 form the Clean and Green fees is $2,571.00.

Motion was made by Commissioner Jeff Eggleston, seconded by Commissioner Benjamin Kafferlin to certify and approve the amount of $2,571.00 as interest earned from the Clean and Green fees in 1015. Motion carried unanimously.

Repository Tax Bid(s): Commissioner Cindy Morrison stated that there are three (3) repository tax bid all made by the same bidder, Mr. James Cripe in the amount of $250 for each of the parcels. These parcels are all mobile homes in Pleasant Township: WN-008-178800-28, WN-008-178800-089, and WN-008-178800-077. Commissioner Cindy Morrison stated that we will make one motion to cover all parcels listed due the bidder and amounts being equal for each parcel.

Motion was made by Commissioner Jeff Eggleston, seconded by Commissioner Benjamin Kafferlin to accept and approve the three bids from Mr. Cripe for the parcels listed above for a total of $825.00. Motion carried unanimously.

Reappointments to the Hospital Authority Board: Motion was made by Commissioner Jeff Eggleston, seconded by Commissioner Benjamin Kafferlin to reappoint both Jean Walker and John Bowler to another five your term on the Warren County Hospital Authority Board effective March 13, 2016. Motion carried unanimously.

Scheduling Software Agreement for 911: Commissioner Cindy Morrison explained that this is a cloud based software that will do scheduling time and attendance and payroll along with certification tracking.

Todd Lake stated that this software will allow schedule change alerts to be sent to the 911 employees, and allow them to look at their schedule and request time off.

Commissioner Jeff Eggleston stated that this was discussed at the work session on Monday and after further discussion because we want to take a further look at this product, along with our own payroll software to see what is available.

Motion was made by Commissioner Jeff Eggleston, seconded by Commissioner Benjamin Kafferlin to table this until the next meeting. Motion carried unanimously.

Resolution #3063 Unified Parcel Identifier Fees Distribution: Commissioner Cindy Morrison stated that in 2008 the board of commissioner’s adopted Ordinance 2-2008B allowing for the collection of $10 per document containing the UPI. But it was never followed through with the resolution to allow both Tax Assessment and the Register Recorder’s office to keep $1.00 per UPI and the remaining $8.00 to go to the general fund. These fees will then be used for records improvement.

Motion was made by Commissioner Benjamin Kafferlin, seconded by Commissioner Jeff Eggleston to approve #3063 for the Unified Parcel Identifier Fees Distribution as stated in the resolution. Motion carried unanimously.

Agreement with Lyell Cook, Erie County Coroner: Commissioner Jeff Eggleston referred to Pam Matve for some history on this and she stated that this is done each year and the amounts have not changed. If we have to have an autopsy done, we send the body to Erie County.

Motion was made by Commissioner Benjamin Kafferlin, seconded by Commissioner Jeff Eggleston to approve the agreement with Lyell Cook, Erie County Coroner with a $5,000 retainer. Motion carried unanimously.

Alternate Representative to (WIB) Workforce Investment Board: Commissioner Cindy Morrison explained that the WIB has asked that Warren County appoint an alternative to sit on the board in the event that Commissioner Benjamin Kafferlin is incapacitated.

Motion was made by Commissioner Benjamin Kafferlin, seconded by Commissioner Cindy Morrison to appoint Commissioner Jeff Eggleston as the alternate for the Workforce Investment Board. Motion carried unanimously noting that Commissioner Jeff Eggleston abstained from the vote process.

Dan Ristau thanked the commissioners for letting him take a few minutes to speak today. Tourism needs to be on the table. I do not know what the solution is but I would like to sit and talk further when you have more time. Commissioner Cindy Morrison stated that a study was done a while back, and Dan stated that she should look at the study; it says it all.

Commissioner Jeff Eggleston stated that we all talked about tourism during our campaigns. Jeff mentioned the branding meeting that will be held in the Jackson courtroom.

Tim Mortenson took a moment to speak on recycling, and he feels the county should set up its own recycling facility. He went on to make a few suggestions, and Commissioner Cindy Morrison stated that while she appreciated his suggestions, it does sound like this is a deeper conversation for another time.
