Warren County Commissioners Public Meeting

February 13, 2019 12:00 p.m.

Main Courtroom

 

Commissioner Benjamin Kafferlin called the meeting of the Warren County Commissioners to order with Commissioner Cindy Morrison and Commissioner Jeff Eggleston present.

 

Staff Present: Pamela Matve, Chief Clerk; Eric Hern, Fiscal Director, Solicitor Nathaniel Schmidt, Director, Ed Burris, Director of Veteran's Affairs, Lori Bimber, Register and Recorder, Phil Gilbert, Tax Claim Director, Lisa Rivett, Director of Elections, Mike Lyon, Zoning Officer and Linda Critzer, Court Administrator

 

Citizens Present: Josh Cotton (WTO), Joe Scully, Connie Zaffino, James Houghtling, Steven Blume, Justin Hansen, and Attorney Tim Sennett

 

Announcements: Commissioner Benjamin Kafferlin stated the few times that two or more commissioners were together at various meetings and or events but no action was taken, nor did our office receive correspondence.

 

Public Hearing: Rezoning Request in Clarendon Borough from R1 to I

 

Mike Lyon stated that today we are here to discuss two parcel; WN-868-181900 and WN-868-181100. These parcels are side by side, and located in Clarendon Borough. Bull Run Resources LLC is requesting that these parcels be rezoned to “I”, Industrial from “R1”, Residential.

 

Justin Hansen stated that they will be using these parcels mainly for repairs on equipment and storage. There will be a driveway for comings and goings, and John Anderson is allowing our trucks to use the larger driveway.

 

Commissioner Cindy Morrison stated that you mention John Anderson Construction is allowing you to use his driveway, is he giving you right of way? To which Mr. Hansen stated no, we had an agreement drawn up for the use of the driveway and his building is right behind ours.

 

James Houghtling, Mead Township, stated that his concern is noise level. Is there any reason for residents to think the noise level will change?

 

Justin Hansen stated that there will be no change in the noise level. There is no manufacturing that will be going on.

 

Commissioner Cindy Morrison asked Mr. Hansen if there is a noise level change, would you object to constructing a buffer. Mr. Hansen stated we would have no objection.

 

Joe Scully asked if the rezoning were to take care of parking, and will you be running the diesel engines at three or four in the morning.

 

Justin Hanses stated that their business hours are from 5:00 a.m. until 5:00 p.m., only in an emergency will we have to start up large truck early in the morning or late at night.

 

After nothing further motion was made by Commissioner Cindy Morrison, seconded by Commissioner Jeff Eggleston to close the public hearing.

 

Public hearing was closed at 12:14 and the normal meting resumed.

 

Public Comment:

 

Linda Critzer stated that at the department head meeting it was stated that the county will be changing to .gov rather than the current .net when will this be happening.

 

Commissioner Jeff Eggleston stated that we have only had one initial meeting with IT and we are in the process of securing the domain name.

 

Linda Critzer asked what additional cost will this be to the departments to which Commissioner Jeff Eggleston stated none, and this will take a while to complete.

 

Linda Critzer then asked if there will be a plan to notify all outside vendors.

 

Commissioner Benjamin Kafferlin stated that during the transition, both email systems will be running concurrently until each of us has had the time to notify all our contacts. I am in favor of this and he gave his opinions as to why.

 

Commissioner Jeff Eggleston stated that .gov will also provide higher security.

 

Commissioner Cindy Morrison stated that she has talked to our IT department and he does not feel we are at risk by leaving things the way they are.

 

Linda Critzer stated that this is a large project and all of our contact will have to be notified.

Elections Cooperative Agreement: Commissioner Benjamin Kafferlin stated asked the Solicitor if he is in                 agreement this to which Mr. Schmidt stated that he has a couple of questions. Commissioner Jeff Eggleston stated that he does not have a problem with tabling this. And we can pass this at a work session               as it is a non-binding agreement.

 

Minutes from the January 23, 2019 Meetings: there are no changes or corrections

 

Fiscal Report: Eric Hern, Fiscal Director stated there was cash on hand of $944,008.00 and in the                Erie         bank account a balance of $647,573.00 now that the payment from the WCDI has been received.

 

Commissioner Cindy Morrison asked Mr. Hern when do you expect to draw on the TAN.  Mr. Hern stated that we are below levels of last year at this same time so it could be in the next three to four weeks.

 

Mr. Hern was then asked about keeping a balance of no less than $500,000.00 in the general fund and is    this being followed? Mr. Hern stated that he and the Treasurer have discussed this and we feel we have a      better handle on the daily balance and we can go lower than that before drawing on the TAN.       Commissioner Cindy Morrison then asked how much lower, and Mr. Hern stated that he does not have a                hard figure.

 

Commissioner Benjamin Kafferlin stated that we set that limit in case of an emergency, I am not worried   that we have to keep $500,000 in the general fund.

Motion was made by Commissioner Cindy Morrison, seconded by Commissioner Jeff Eggleston to approve today’s agenda, the January 23, 2019 minutes, and the fiscal report as presented. Motion carried unanimously.

 

Old Business:

 

Appointment of Phil Gilbert to the Warren County RDA: Commissioner Benjamin Kafferlin this was tabled and the RDA have amended their bylaws to include that the five board membership does not exclude elected officials.

 

Later in the agenda we also have the appointment of Joe Scully to the Warren County RDA so why do we not do this both together.

 

Motion was made by Commissioner Cindy Morrison, seconded by Commissioner Jeff Eggleston to approve the appointments of Phil Gilbert and Joe Scully to the Warren County RDA.

 

Commissioner Cindy Morrison stated that she still has reservations on Mr. Gilbert’s appointment as he is the Tax Claim Director.

 

Solicitor Nathaniel Schmidt stated that the only time there is a conflict is when an RDA member has direct ownership of a property.

 

Joe Scully stated that he accepts his appointment.

 

The above motion was then called to question and the motion carried two to one with Commissioner Benjamin Kafferlin and Commissioner Jeff Eggleston for and Commissioner Cindy Morrison against.

 

Agreement with Lonnie Heeter for Inmate Medical Care: Solicitor Nathaniel Schmidt stated that he has drawn up an agreement to cover all the areas of concern; the prior agreement is very vague.

 

Motion was made by Commissioner Cindy Morrison, seconded by Commissioner Jeff Eggleston to approve the agreement as presented today. Motion carried unanimously.

 

Consulting Agreement with Todd Lake: Commissioner Benjamin Kafferlin stated that Solicitor Nathaniel Schmidt has drawn up a consulting agreement for Todd Lake and the reason for this is that there are some issues and equipment that Ken McCorrison, Public Safety Director is not up to speed at this time. Therefore we would like to be able to call upon the valuable knowledge that Mr. Lake has.

 

Commissioner Cindy Morrison stated that she has concerns regarding the amount of time that Mr. Lake will be called upon. I feel that there should be some hourly restraints and an ending to this agreement. Mr. McCorrison was hired for this position due to his knowledge, and that is why we did not advertise this position. I do not want to be paying two people to do this job.

 

Commissioner Benjamin Kafferlin stated that I do not know the amount of hours to which Mr. Lake will be used, but it will not be that often. How about capping the hours at 20 hours per month and the expiration of the agreement would be July 1, 2019.

 

Solicitor Nathaniel Schmidt stated that the agreement can be changed. Eric Hern, Fiscal Director stated that Ken McCorrison, Public Safety Director should also have a say in the changes.

 

Commissioner Jeff Eggleston stated that he feels this is an administrative decision, and does not feel this should be part of the agreement. I am happy that we can put something like this together as we have many employees who have left the county with a lot of knowledge.

 

Commissioner Cindy Morrison asked if we can go ahead and vote on this today with the stipulated changes.

 

Motion was made by Commissioner Cindy Morrison, seconded by Commissioner Jeff Eggleston to approve the consulting agreement with Todd Lake with an hourly rate of $65.00 per hour, stipulating no more than 20 hours per month, and an expiration date of July 1, 2019. Motion carried unanimously.

 

New Business:

 

Ordinance 252 Rezoning Request of Parcels WN-868-181900 and WN-868-181100: Motion was made by Commissioner Cindy Morrison, seconded by Commissioner Jeff Eggleston to approve Ordinance 252 allowing the rezoning of parcels WN-868-181900 and WN-868-181100 from R1 to I. Motion carried unanimously.

 

Repository Tax Bid(s): Motion was made by Commissioner Cindy Morrison, seconded by Commissioner Jeff Eggleston to approve the Repository Tax Bid from Dennis Gesin for parcel TD-196-388100-000, Tidioute Borough, in the amount of $905.00. Motion carried unanimously.

 

Resolution #3133 Obligation Bond (radio system): Tim Sennett stated that this bond is with the USDA at a much lower interest rate. These funds cannot be used for anything but the Motorola radio project.

 

Commissioner Jeff Eggleston thanked Commissioner Benjamin Kafferlin for all his hard work to see this project through. Commissioner Benjamin Kafferlin stated that he may have initiated the project but the large part of the work was done by Todd Lake, Ken McCorrison and others.

 

Motion was made by Commissioner Cindy Morrison, seconded by Commissioner Jeff Eggleston to approve Resolution #3133 for the Obligation Bond for USDA funds for the Motorola radio project. Motion carried unanimously.

 

Consulting Agreement with Wanda Smith: Commissioner Benjamin Kafferlin stated Wanda Smith has offered to come back periodically when needed for grants, training etc. I know the annual report is due soon and Wanda has the knowledge to get this done.

 

Commissioner Cindy Morrison stated that she has the same concerns for this agreement as the one for Todd Lake.

 

Commissioner Jeff Eggleston stated that he is not sure 20 hours per month is adequate. Commissioner Benjamin Kafferlin stated he is confident that it will be enough.

 

Connie Zaffino asked about the fees, to which Commissioner Benjamin Kafferlin stated that Todd Lake is $65.00 per hour and Ms. Smith is at $25.00 and both will be 1099 vendors.

 

Motion was made by Commissioner Cindy Morrison, seconded by Commissioner Jeff Eggleston to approve the consulting agreement with Wanda Smith with an hourly rate of $25.00 per hour, stipulating no more than 20 hours per month, and an expiration date of July 1, 2019. Motion carried unanimously.

Commissioner Cindy Morrison stated that at the last meeting I requested that I be sent an email of when people are hired. I have seen people on the street that have applied and they ask me about it, and I did not know we had hired someone.

 

Motion was made by Commissioner Cindy Morrison, seconded by Commissioner Jeff Eggleston to approve the Personnel as presented. Motion carried unanimously.
